RETURNS POLICY

Returns at the consumer’s or user’s expense

If you do not wish or are unable to return the products through our distributor stores, you will be responsible for the return costs. Please note that if you decide to return the products carriage forward, we will be entitled to charge you for any expenses incurred.

After examining the item we will inform you whether you are entitled to a refund of the amounts paid. Please remember that the refund of transport costs will only be made when the right of withdrawal is exercised within the legal period and all components of the product in question are returned. The refund will be made as soon as possible and, in any case, within 14 days from the date on which you informed us of your intention to withdraw. However, we may withhold the refund until we have received the goods, or until you provide proof of having returned the goods, whichever condition is met first. The refund will always be made using the same means of payment that you used to pay for the purchase. You will bear the cost and risk of returning the products to us. Returns in the Canary Islands, Ceuta and Melilla

If you wish to exchange or return a product that was delivered in the Canary Islands, Ceuta or Melilla, you may do so by visiting one of our distributor stores in person, as provided in this clause. If this is not possible, you must contact us at devoluciones@homebyfama.com or by calling +34 968 11 13 57 to arrange with us or our representative the delivery of the product at a collection point or to return it at your own cost.


Exchange of product for another colour or size

If you consider that the colour or size of the product purchased does not suit your needs, and without prejudice to your statutory and contractual right of withdrawal, you must carry out the exchange of the product by first returning the purchased item and then purchasing the new product you wish to acquire. In this case, the provisions mentioned regarding the right of withdrawal and common provisions for product returns will apply.

Return in store

You must return the products purchased in one of our distributor stores within 14 calendar days from the date on which you inform us of your decision to withdraw from the contract.

We will bear the costs of returning the goods.

Return at the customer’s or user’s expense

You must return or deliver the goods directly to HomebyFama, at the address: C/ Dr. Barraquer i Roviralta, S/N, FAMA SOFAS S.L.U., C.P. 30510, Yecla (Murcia), without undue delay and, in any event, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. The deadline will be deemed to have been met if you return the goods before the period has expired.

You must bear the direct cost of returning the goods.

You will only be liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.


Contractual right of withdrawal

In addition to the statutory right of withdrawal granted to consumers and users and mentioned in the previous clause, Home by Fama grants you a period of 30 days from the material acquisition of the goods to return the products (except for customised items or items manufactured at the consumer’s and user’s request).

Please note that the 30-day period will be calculated without excluding non-working days. In the event that the products are returned within the contractual period but after the statutory withdrawal period of 14 calendar days, only the price paid for the products will be refunded. You will bear the direct costs of returning the product when the return is not made in one of our distributor stores.

In any case, you must return the goods within the 30-day period from the material acquisition of the goods or products.


Common provisions

You do not have the right to withdraw from the contract for products that are customised or manufactured at the consumer’s and user’s request.

Please return the item using all its original packaging, instructions and other documents that may accompany it. No refund will be made for products that have suffered any kind of damage or are not in the same condition as when they were delivered.


Returns in distributor stores

You may return any item purchased through our website at any of our Home by Fama distributor stores (check stores here). In this case, you may go to your nearest store and must hand in the product together with the electronic receipt received with the order confirmation, which is also available in your website account. If a printed receipt is requested, it may be presented at the store instead of the electronic receipt. This option will not incur any additional cost.

Returns of defective products

In cases where you consider that, at the time of delivery, the product does not conform to the terms of the contract, you must contact us immediately through our contact channels providing the product details as well as information about the damage, or by calling +34 968 11 13 57 where we will indicate how to proceed.

You may return the product to any of our distributor stores in Spain or by postage paid.

Once the product has reached Home by Fama, we will carefully examine the returned product and will inform you by email within a reasonable period whether a refund or replacement is appropriate (as you decide). The refund or replacement of the item will be made as soon as possible and, in any case, within 14 days from the date on which we notify you by email that the refund or replacement of the defective item is accepted.

The amounts paid for items returned due to a defect or flaw, when such defect actually exists, will be fully refunded to you, including the delivery costs incurred to deliver the item and the costs you incurred in returning it to Home by Fama. The refund will be made using the same means of payment you used for the purchase. If we consider that the returned item does not have any defect or flaw, the return costs will be borne by you.

Your rights under the applicable legislation will in any case remain unaffected.
